Template: Farm Business Tenancy Agreement

This document creates a specific type of lease for a property where the tenant is in a farming based business.

The duration of the contract can be between 2 years and 60 years with regular rent reviews. Note that we also provide a similar document specifically for terms of less than two years (see below).

This document contains a large choice of 62 positive obligations and restrictions on the tenant to ensure that the land is used as the landlord wishes.

A FBT agreement is suitable in circumstances where:

  • all or part of the land is farmed for trade or business throughout the tenancy
  • the landlord and the tenant have exchanged notices at the beginning of the tenancy saying that the agreement is and will remain a farm business tenancy
  • the circumstances of occupation suggest that the character of the tenancy is primarily agricultural."

Template: Farm Business Tenancy Agreement (2 years or under)

"This lease is suitable either when the landlord and tenant agree that the agreement is a farm business tenancy, or when the land and buildings being let will be farmed or used for agricultural business purposes. The term of the lease should be 2 years or less. Under the Agricultural Tenancies Act 1995, farm business tenancies of less than two years expire automatically at the end of the term, and without the need for the landlord to give notice.

This document should be used if:

Template: Grazing Agreement

"This contract creates a short term licence to graze a field or otherwise allow animals to feed on land – beneficial because such arrangements fall outside the Landlord and Tenant Act and the Agricultural Tenancies Act. It gives the landowner much greater control over what the licencsr can do and how quickly the licence can be ended. It can permit the grazing any animal on any type of land, from horses and livestock on grass, to pigs in woodland, to fowl on wetland."

Template: Agricultural Licence: to occupy land with stables; barn or other out-buildings

"Grant a licence to occupy agricultural land and/or buildings for non-business use.

Typical uses might be for keeping horses or other animals under cover, personal storage of vehicles or other possessions, and recreational riding (for example, in an arena).

Care of the property is likely to be important to the owner, and so we have included provisions that require the licensee to maintain its upkeep. The property could be a building (such as stables, a barn or a workshop) or a set of buildings, or land of any sort including fields, woodland and orchards, or a combination."

Template: Agricultural Lease: private grazing or non-agricultural business use

"This lease has been drawn primarily for the purpose of allowing private individuals to use fields (perhaps with buildings on them) for grazing or keeping animals. It is flexible so that it can be used to let rural land for other purposes, such as recreational riding, a camp site business, or a sports field. The document contains specific provisions to ensure that the land is well maintained by the tenant.

This is a lease agreement for agricultural land (one or more fields, perhaps with buildings or shelters) to be used for personal use or non-agricultural business use for up to 7 years.

We presume that the most common use of this document will be for medium term private grazing such as by a neighbour who requires more space for a livery business). However, it is just as suitable for any other non-agricultural business use, such as for a camp site, a sports field, a clay pigeon shooting centre or a safari park."

Template: Agricultural Land Licence: to hold a show; fair or other event

"This agreement allows you to give permission to someone else to hold an event, show or fair on your land for a short and specific period of time. The types of events that could be held include local shows, equestrian competitions or wedding parties. Since the land is likely to be of high value, the document contains provisions that ensure the occupier looks after it.

Use this agreement to allow a third party to use your land for an event. Whatever it is, it should take place for a short period of time, such as over three days in June, or every third Saturday in the month between March and September. The agreement allows additional time for setting out, packing up and cleaning.

Example uses would be to allow:

  • a local show or an equestrian three day event
  • a non-agricultural show such as a fireworks display, a temporary fairground, a fete or a circus
  • a car boot sale or a farmers market
  • product displays of goods - tents, caravans, tractors or other machinery in a field
  • sports competitions, whether a show jumping competition or a community football match
  • weddings or other private parties (somewhere to put a marquee)."
